LCF Law Group defended the client in criminal proceeding
The Court of Appeal upheld the position of LCF Law Group attorneys and closed the criminal proceedings due to the expiration of the pre-trial investigation (Article 284 (10) of the Criminal Procedure Code of Ukraine).
Almost a year and a half of litigation ended with the client’s victory thanks to the efforts of LCF lawyers. At first, the lawyers canceled the decision to suspend the pre-trial investigation in court. The reason was that the investigators had not confirmed the suspect’s hiding place.
After this decision was canceled, the prosecutor’s office had to close the criminal proceedings. However, this did not happen. The prosecutor’s office sent the indictment to court because it believed that the pre-trial investigation had not expired. The lawyers in the court of first instance filed a motion to close the proceedings. The court took into account the evidence of the defense and closed the criminal proceedings.
The prosecutor appealed the closure of the proceedings, but the Court of Appeal upheld the previous decision.
