LCF Law Group Helps Service Member Defend His Right to Military Pay During Medical Treatment

LCF Law Group represented a service member who did not receive military pay during an extended period of medical treatment. The LCF team challenged this inaction in court and established the client’s right to receive the unpaid military pay. The court of first instance upheld the claim. The military unit appealed, but the court of appeal dismissed the appeal. The Supreme Court declined to initiate cassation proceedings. Although the court decision was final, the client did not receive the funds for an extended period. The LCF team initiated enforcement proceedings to ensure compliance with the judgment.

Meanwhile, the service member continued to be denied military pay for a subsequent period of medical treatment. Because these payments were not included in the initial court decision, LCF lawyers filed a new claim. In the new claim, the team sought payment of military pay for the additional treatment period and compensation for income lost due to the delayed payment. The court fully supported the client’s position and granted the claim in full.

This pro bono case demonstrates the protection of service members’ rights to financial support during medical treatment. It also confirms that military units may be held responsible for both non-payment and the consequences of delayed payments.
